These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “your”) and Leigh Hinton for Melbourne City Council, District 2 (“Campaign,” “we,” “us,” or “our”) governing your use of the website at votehinton2026.org (the “Website”) and participation in our SMS/MMS messaging program, Leigh Hinton Campaign Alerts (the “SMS Program”).

By accessing or using the Website, submitting any form, or opting in to the SMS Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, do not use the Website or opt in to the SMS Program.

Contributions & Donations

By making a contribution through this Website, you represent and confirm that:

Florida law requires us to collect and report the name, mailing address, occupation, and employer of individuals whose contributions exceed $100 in an election cycle. Contribution information is reported to the Brevard County Supervisor of Elections and the Florida Division of Elections and becomes part of the public record.

Donations are processed through ActBlue, a registered political committee and licensed payment processor. ActBlue’s own terms of service and privacy policy apply to the payment processing of your contribution. We do not store your credit card or payment information on our servers.

SMS/MMS Terms and Conditions — Leigh Hinton Campaign Alerts

The following SMS/MMS Terms and Conditions apply to the Leigh Hinton Campaign Alerts program operated by Leigh Hinton for Melbourne City Council, District 2. By opting in to the SMS Program, you agree to these terms in addition to our Privacy Policy.

1. Program Description

The Leigh Hinton Campaign Alerts program sends recurring automated campaign-related text messages (SMS and MMS) to supporters who opt in. Messaging use cases include: campaign updates and announcements, volunteer coordination and scheduling, event invitations and reminders, calls to action, donation acknowledgments and fundraising updates, election day reminders, and general campaign news.

You may opt in to receive text messages from the Campaign by:

By opting in through any of the above methods, you expressly consent to receive recurring automated campaign-related text messages (SMS and MMS) at the mobile phone number you provided, including messages sent using an automatic telephone dialing system (autodialer) or prerecorded/artificial voice technology, as applicable. Your consent is provided to Leigh Hinton for Melbourne City Council, District 2.

3. Message Frequency

Message frequency varies based on campaign activity. You may receive up to 10 messages per month during regular periods and up to 20 messages per month during active campaign periods leading up to the election. Message frequency is not fixed and may increase during critical campaign periods.

Message and data rates may apply. Please consult your mobile carrier for details about your text messaging and data plan. You are solely responsible for any charges from your wireless carrier related to receiving text messages from the SMS Program.

5. How to Opt Out

You may opt out of receiving text messages at any time by replying STOP to any campaign text message. You may also text STOP to our campaign phone number at any time. After opting out, you will receive a one-time confirmation message stating: “You have been unsubscribed from Leigh Hinton Campaign Alerts. You will no longer receive text messages from this campaign. Reply START to re-subscribe.” No further messages will be sent unless you opt in again by texting START or re-enrolling through one of the opt-in methods described above.

You must be at least 18 years of age to opt in to the Leigh Hinton Campaign Alerts SMS Program. By opting in, you confirm that you are 18 years of age or older. If we learn that we have collected information from a person under 18 without parental consent, we will promptly delete that information and remove them from the SMS Program.

8. Consent Not Required for Purchase or Services

Your consent to receive text messages is not required as a condition of making a donation, signing a petition, volunteering, or engaging in any other activity with this Campaign. You may participate in all Campaign activities without opting in to the SMS Program.

9. No Sharing of Opt-In Data

We will not sell, rent, lease, loan, trade, or otherwise share or disclose your mobile phone number, opt-in status, or any information collected through the SMS Program to any third party for their own marketing or promotional purposes. Your phone number and opt-in data are used solely for Campaign communications from Leigh Hinton for Melbourne City Council, District 2.

10. Supported Carriers & Carrier Liability Disclaimer

The SMS Program is supported on most major U.S. wireless carriers including but not limited to AT&T, T-Mobile, Verizon, Sprint, U.S. Cellular, Cricket, MetroPCS, and others. Service and message delivery are subject to carrier network availability and coverage. Carriers are not liable for delayed or undelivered messages. T-Mobile is not liable for delayed or undelivered messages. By participating in the SMS Program, you agree that wireless carriers, including but not limited to AT&T, T-Mobile, Verizon, Sprint, and their affiliates, are not liable for any delays, failures, or errors in the transmission of text messages sent as part of this program, regardless of the cause.

11. TCPA Compliance

The SMS Program is operated in compliance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable Federal Communications Commission (FCC) regulations. We only send text messages to individuals who have provided their prior express consent. We maintain records of consent (including opt-in date, method, and content) for a minimum of four (4) years. If you believe you have received a message in error, please reply STOP or contact us immediately.

This SMS Program follows the CTIA Messaging Principles and Best Practices and the CTIA Short Code Monitoring Handbook guidelines for consumer consent, opt-out processing, and message content.

Dispute Resolution & Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or the SMS Program shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution in the state or federal courts located in Brevard County, Florida.

You agree to submit to the personal jurisdiction of the courts located in Brevard County, Florida, and waive any objection to venue in such courts.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Campaign regarding your use of the Website and SMS Program, and supersede all prior or contemporaneous agreements, representations, and understandings.
